Terms of use / WM agreement

The following agreement is a legal agreement between You and Wild-Mountain.net (represented by its webmaster). By using the Website You agree to respect the terms of this Agreement. If You do not agree with Terms of use, please do not use the Website.
This agreement may be revised or updated without notice.

1. Use of this Website and the photos

By browsing this Website you have access to numerous photos. All photos and their descriptions are the property of WM Members and are protected by international copyright laws.
You may not use this image in a commercial or incorrect way, i.e. you may not sell, license, sublicense, rent, transfer or distribute any Photo and you may not use any photo in an offensive, indecent, discriminating, libellous or objectionable way.

To use any photo publicly, you have to notify and ask for permission of its author. The photographer is the only person who can authorize the use of a photo outside Wild-Mountain.net.

You agree to use the photos only as expressly permitted by this Agreement and in accordance with all applicable laws, rules and regulations.

2. Termination

Wild-Mountain may terminate this agreement immediately if you breach this agreement or for any other particular reason.

3. Privacy policy

Wild-Mountain may collect some information about users of the wiki and the forum. Wild-Mountain holds your data confidentially, it will not be sold to any third parties and it will not be seen by the public.
You can modify your information in the Preference section (wiki) or in the Profile section (forum). Wiki and forum accounts are currently independent.
By creating a wiki or forum account, you agree to receive E-Mails related to WM updates. If needed you can choose to hide your contact information (see configuration sections above).

4. Indemnification

You agree to indemnify, defend, and hold harmless Wild-Mountain and its webmaster against any claims, losses, damages, liabilities, costs and expenses, including reasonable legal fees and expenses, due to or related to a breach of this Agreement, the use of this Website or the use of any photo.

5. Report a mistake or an breach of agreement

If you believe that a photo of this Website is yours or is not the property of the mentioned author, please contact the author and/or the webmaster to report this mistake.
If you find a mistake, including a wrong description, a title and a photo which do not match, you can contact the webmaster here.

6. Warranty and Liability

WILD-MOUNTAIN AND ITS WEBMASTER OFFER NO WARRANTY, EXPLICIT OR IMPLIED, WITH RESPECT TO THE PHOTOS, THE WEBSITE, THE INFORMATION ON THE WEBSITE, THE SERVICES OR ANY RIGHTS OR LICENSES UNDER THIS AGREEMENT INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
WILD-MOUNTAIN DOES NOT WARRANT THAT THE WEBSITE AND ITS CONTENT WILL MEET YOUR NEEDS OR THAT THEY WILL BE UNINTERRUPTED OR ERROR FREE.

WILD-MOUNTAIN AND ITS WEBMASTER SHALL NOT BE LIABLE TO YOU OR TO ANY OTHER PERSON OR ENTITY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES (INCLUDING: LOSS OF USE, LOSS PROFITS OR REVENUES, COSTS OR LOSSES) ARISING OUT OF YOUR USE OF THE WEBSITE OR ANY PHOTO.
